جنبه‌های گوناگون«مسئولیت» در حقوق بین‌الملل کیفری

چکیده

تحولات معاصر در حوزه حقوق بین‌الملل، نتیجه تولد مفاهیم جدیدی از مفهوم حاکمیت دولتها می‌باشد. در مفهموم کلاسیک حاکمیت دولتها، قدرتهای حاکم از مصونیتهای خاصی برخوردار بوده که در پرتو این مصونیتها، دولتها دارای اقتدار عام و خدشه‌ناپذیر بوده و هیچ مکانیزم خاصی برای کنترل رفتار حاکمیتها در ارتباط با اعمال آنها پیش‌بینی نشده بود. بر همین اساس نیز منشور سازمان ملل متحد نیز با تصریح بر اصالت حاکمیتها، مقررات این منشور را از دخالت در حوزه حاکمیتی دولتها بازداشته و مرز مشروعیت اقدامات سایر دولتها و سازمانهای بین‌المللی را تا حد رعایت کامل اصل «حاکمیت دولتها» و «برابری حاکمیتها» شناسائی نموده است. تحولات پیش‌گفته در عرصه حقوق بین‌الملل بویژه پس از پایان جنگ جهانی دوم، موجب شد تا «حقوق فرد» منصرف از انتسابات ملیتی، نژادی و قومیتی، موضوعیت یافته و دولتها در رفتار با ملتهای خود، تابع اصول و مقررات خاصی باشند که در یک مفهوم کلی، از این مقررات با عنوان «مقررات حقوق بشر» یاد می‌شود. این مسئله به همراه طرح موضوعات جدی تخلفات دولتها در حوزه حقوق بین‌الملل کیفری، سبب شد تا در این شاخه از حقوق بین‌الملل عام نیز تعهداتی خاص بر عهده دولتها قرار داده شود که این تعهدات، جدای از تعهدات اصلی حقوق بین‌الملل کیفری و اصل «مسئولیت کیفری فردی» می‌باشد. اساسنامه‌های دادگاههای کیفری یوگسلاوی و روآندا و اساسنامه دیوان کیفری بین‌المللی با تدوین تعهدات ویژه دولتها در حوزه «همکاری بین‌المللی»، حیطه حاکمیت دولتها را هم بوسیله «نفی مصونیت سیاسی» و هم با توسل به «تعهد به همکاری دولتها»، محدود نموده و در کنار مفاهیم جدید مقررات حقوق بشر از جمله «مسئولیت حمایت»، دایره بی‌مسئولیتی حاکمیتها در قبال رفتار با افراد را تنگ تر نموده است. در نتیجه تحولات فوق الذکر، در حال حاضر مقررات حقوق بین‌الملل کیفری، با تفکیک بین «جرائم بین‌المللی» و «جنایات بین‌المللی»، دامنه مسئولیتهای ناشی از دسته اخیر تخلفات بین‌المللی دولتها را فراتر از «مسئولیت بین‌المللی دولتها» که عمدتاً بر اصل «جبران خسارت» متمرکز بوده و «مجازاتهای تنبیهی» در آنها موضوعیتی نداشت، ترسیم نموده است که نتیجه این تحول، ایجاد مسئولیتهای متعدد (فردی و دولتی) در حقوق بین‌الملل کیفری شده است.

Various Aspects of Responsibility in International Criminal Law

Current changes in the international law are a consequence of new fundamental concepts of the sovereignty of states. In the classical meaning of the sovereignty of states, states used to enjoy special immunity. Under the cover of immunity, states possessed absolute authority and inviolability. No mechanism of control with respect to their dealings had been taken into consideration. Established on the same foundation of inviolable authority, the pertinent United Nations Charter did not allow the intervention of the charter in the sphere of the sovereignty of states. The Charter identified the legitimacy of dealings of states and international organisations dependent of strict consideration of the principles of ’the sovereignty of states’ and ’equality of states’. Changes in the international law have, especially after the second World War, led to ’individual rights’, irrespective of nationality, race, or kind of people. With respect to their inhabitants, states are bound to follow those principles and regulations that are generally referred to as ’the laws of human rights’. The coming into existence of human rights as well as the commitment of serious offences by states against the international criminal law have brought about special enactments on states codified in the general international law. The special enactments are additional to the code of  international criminal laws and the laws of criminal responsibility of an individual. As a result of the Contemporary developments, the current international criminal law has, by way of making a distinction between International Crimes and International Felony(Delict), brought about an increase in their responsibilities beyond the regular international responsibility of states. International responsibility of states was mainly performed on the principle of compensation of damage, whereas no punitive penalties were characteristic of them and this is something which is totally different with responsibilities in international criminal law.
