خسارات تنبیهی در حقوق بین‌الملل

چکیده

خسارات تنبیهی خساراتی هستند که دارای ماهیت ترمیمی نبوده و برای تنبیه و جلوگیری از رفتار قابل سرزنش خوانده مورد حکم قرار می‌گیرند. خاستگاه اصلی این خسارات حقوق کامن‌لا می‌باشد. محاکم دولتهای پیرو این نظام حقوقی مطابق حکم مجلس اعیان انگلیس پرداخت این دسته خسارات را محدود به موارد معینی کرده‌اند که غالباً رعایت می‌شود درحالی‌که در دو کشور استرالیا و ایالات متحده امریکا محدودیتهای مورد نظر مجلس اعیان مورد توجه قرار نگرفته و حتی در مورد کشور اخیر حکم به پرداخت این خسارات به دعاوی مطروحه علیه دولتهای خارجی نیز سرایت کرده است. رویه مذکور مسأله مشروعیت خسارات تنبیهی را در حقوق بین‌الملل مطرح می‌سازد. مطالعه قواعد حاکم بر مسؤولیت دولتها در حقوق بین‌الملل و رویه قضایی بین‌المللی نشان‌دهنده این واقعیت است که با وجود شباهت این نوع خسارات با مصادیق جلب رضایت در حقوق مسؤولیت مدنی، اصولاً مجوزی برای حکم به پرداخت این‌گونه خسارات در حقوق بین‌الملل وجود نداشته و رویه محاکم ایالات متحده در حکم به پرداخت خسارتهای تنبیهی علیه دولتهای خارجی از جمله دولت جمهوری اسلامی ایران فاقد هر نوع جایگاه حقوقی است و در آینده مسؤولیت بین‌المللی آن دولت را بوجود خواهد آورد.

Punitive Damages in International Law

Punitive Damages are not compensation for injury and is levied to punish reprehensible conduct of defendant and to deter its future occurrence. Common law is the base of this approach. According to the U.K. House of Lords, there are some restrictions in levying this kind of damage. These restrictions have been fully respected by the courts of all the Commonwealth States except Australia and the United States. Even in the United States this approach has been recently extended to cases in which a foreign State is a defendant. This practice poses the question of the legality of Punitive Damages in International Law. A study of international responsibility rules and relevant case law shows that although there are some similarities between Punitive Damages and Satisfaction in international rules of State responsibility, it is not principally permitted to pass a judgment on punitive damages against a State. Therefore, the recent practice of the United States courts in convicting foreign States including Islamic Republic of Iran is a violation of international law and entails in international responsibility of that State.
