They are, historically, simultaneous with human being. Muslims, as soon as Islam was founded and established its stability, made political and legal relations with the followers of other religions. Islamic nation often had bilateral relations with the other nations. The fundamental question in this article is that whether these relations with others are based on war or peace? There are 2 theories regarding political-legal relations of Muslims with the followers of other religions and non-believers. The owners of first theory maintain to principality of war, according to the second theory peace is prior upon war. On my opinion the true doctrine is the second theory which believes in principality of peace. According to this view, the essential rule in relation between Muslims and the others is Peace, which is eternal and natural. War, however, is accidental and not normal. Islam by its nature and all other divine religions radically are opposed to fighting and blood shed. If Islamic injunctions ordered us to be equipped, it would be only because of defense for the followers of Islam. Considering holy verses of Quran, tradition of prophet (Peace be upon him) and his holy household indicates that in Islam peace is essential. According to this point of view relation of Islamic territory {Darulislam} with the other non-Islamic countries {Darulkufr or Darulshirk} is peaceful, because of contracts, cease fire and neutrality. hence a country that is combating against an Islamic country by breaching a treaty or by conducting an aggression is called territory of war {Darulharb}. Otherwise it is neutral or it has a league with Islamic country is referred to as {Darulhiad}. The nature of the political and legal relation between Muslims and other non-Islamic countries, first of all, is peaceful, friendly and is based on dignity and peaceful co-existence. It is legalized by a contract, in neutrality and cease fire. A war according to this doctrine is exceptional and accidental, it is permissible, only in some rare circumstances and it is, when Islamic country has no remedy for its inevitability. So, out of necessity an Islamic country is obliged to acquire, modern and advanced equipments and armaments in military and security fields, if they want to be free, developed and independent, and to have powerful, dignitive, wisely and expediently relations with other countries.}, keywords = {Islamic international law,Islam,Authenticity of war,Authenticity of peace,Holy war {Jihad},Defense equipment}, title_fa = {اسلام، اصالت جنگ یا اصالت صلح؟}, abstract_fa = {جنگ‌ و صلح‌ دو وضعیّت‌ کاملاً متمایز از یکدیگرند که بر هرکدام‌ آثار خاص‌ و قواعد حقوقی‌ ویژه‌ای‌ مترتّب‌ است‌ و‌ پیشینه‌ای‌ به‌ اندازة‌ تاریخ‌ بشریّت‌ دارند. حکومتهای اسلامی‌ در دوران‌ تأسیس‌ و استقرار کامل‌ اسلام‌، با حکومتهای سایر ادیان‌ و ملل‌ غیرمسلمان‌، روابط سیاسی‌ ـ حقوقی‌ برقرار کرده و ارتباطات‌ دیپلماتیک‌ داشته‌اند. سؤال‌ اصلی این‌ نوشتار این‌ است‌ که‌ آیا در روابط کشورهای ‌اسلامی با ملل‌ غیرمسلمان‌، اصل‌ اولیه‌، جنگ‌ است‌ یا صلح‌؟ در این مقاله، دو دیدگاه مهم در زمینه روابط سیاسی ـ حقوقی حکومت‌های اسلامی با پیروان سایر ادیان و مشرکان بررسی و تحلیل گردیده است. دیدگاه اول قائل به اصالت جنگ و دیدگاه دوم معتقد به اصالت صلح است. قول قوی و رأی صائب، دیدگاه اصالت صلح است. بر اساس این دیدگاه، اصل اولیه و حالت اصلی در روابط بین حکومت های اسلامی و سایرین، صلح است. قاعدة همیشگی و جاوید، صلح است و جنگ، عارض بر آن است. روح اسلام و اصولاً همه ادیان الهی، با جنگ و خونریزی بی اساس مخالف است و اگر فرمان به آمادگی داده است، هدف آن، دفاع از موجودیت و کیان دین است. بررسی آیات شریفه قرآن، سنت پیامبر و حضرات معصومان(ع) نشان می‌دهد که روح اسلامی، صلح است. بر اساس این دیدگاه، رابطه دار الاسلام با بقیه کشورهای غیراسلامی، که از حیث عقیدتی دار الکفر یا دار الشرک هستند، صلح آمیز است که یا عنوان دار العهد یا دار الهدنه و یا دار الحیاد را خواهند داشت. بر این اساس، کشوری عنوان دار الحرب را خواهد داشت که بالفعل با تجاوز یا نقض پیمان با کشور اسلامی در حال کارزار باشد. در غیر این صورت، یا کشور بی‌طرف و جزو دار الحیاد است یا هم پیمان با کشور اسلامی. بنابراین، ارتباط سیاسی و حقوقی بین کشورهای اسلامی و سایر کشورهای غیر مسلمان، در حالت اولیه، «صلح و همزیستی مسالمت‌آمیز دوستانه و شرافتمندانه» است که در قالب عهد و پیمان یا بی طرفی، صورت قانونی می‌گیرد و جنگ در حوزه این نظریه، حالتی عارضی و استثنایی است که در برخی شرایط رخ می‌دهد و کشور اسلامی، گریزی از آن ندارد. اگر تجاوزی صورت گیرد، دفاع مقتدرانه لازم است. بنابراین، آمادگی کامل نظامی‌ ـ امنیتی با تجهیز به آخرین فناوری‌ها و دستاوردهای روز از جمله ضروریات کشور مستقل اسلامی است که می‌خواهد «آزاد»، «آباد» و «مستقل» در نظام بین‌المللی گام بردارد و روابط خود را با دیگر کشورها، مبتنی بر «عزت»، «حکمت» و «مصلحت» نماید.}, keywords_fa = {حقوق بین‌الملل اسلامی,اسلام,اصل جنگ,اصل صلح,جهاد,آمادگی دفاعی}, url = {https://www.cilamag.ir/article_17972.html}, eprint = {https://www.cilamag.ir/article_17972_f3aa9c6d786bf74d8f6ca3b1a8a5bb3f.pdf} }
