By examining the international documents and jurisprudence of the courts, this hypothesis is studied that despite of the presence of the prevailing standard about the appreciation of the meaning of “torture”, there are other standards adopted by international documents and jurisprudence of the courts. To examine this hypothesis, firstly, the prevailing standard is studied. According to this standard, “torture” is the official behavior or punishment which brings about much pain or suffering and is used to result in special purposes such as collection of information or confession. Then, those different standards are examined. Based on these standards, “torture” does not have to be necessarily “official”, nor does it concern the “intensity” of the pain or suffering, nor even the “existence” of “pain or suffering”, but the “purposefulness” of torture is rejected. Of course, although these approaches are different from each other, they do not contradict with the other one. It means, in the same way, as some judicial or pseudo - judicial authorities have illustrated, these differences can be complementary of each other by choosing a free and broad interpretation. Of course, this is the ideal, but the fact is if the judicial or pseudo - judicial authorities do not adopt such an interpretation, potentially, there is a capacity to adopt different methods, different appreciation and inferences of the meaning of “torture” in the international arena which can be propagated and leads to the weakening of the concept and challenging with such behaviors.}, keywords = {}, title_fa = {مفهوم شکنجه: استاندارد واحد یا متفاوت (از دیدگاه حقوق بین‌الملل)}, abstract_fa = {از آنجایی که دایره معنای اصطلاح شکنجه در حقوق بین‌الملل مد نظر است؛ لذا این تحقیق وارد قلمرو حقوق داخلی نمی‌شود و صرفاً دیدگاه حقوق بین‌الملل مورد بررسی قرار می‌گیرد. با بررسی اسناد و رویه قضایی بین‌المللی این فرضیه مورد آزمون قرار می‌گیرد که علی‌رغم وجود استاندارد غالب در مورد فهم اصطلاح شکنجه، استانداردهای دیگری نیز از طریق اسناد و رویه قضایی بین‌المللی اتخاذ شده است که با آن استاندارد متفاوت می‌باشند. برای آزمودن فرضیه ابتدا استاندارد غالب مورد بررسی قرار می‌گیرد. مطابق این استاندارد، شکنجه رفتار یا مجازات رسمی یا دولتی است که رنج شدیدی ایجاد می‌کند و برای نیل به اهداف خاصی از قبیل کسب اطلاعات یا اقرار اعمال می‌شود. سپس استانداردهای متفاوت با آن استاندارد مورد بررسی قرار می‌گیرد. مطابق این استانداردها، یا «دولتی و رسمی» بودن شکنجه و یا «شدید بودن» درد و رنج و یا اصلاً وجود «درد و رنج» لازم نبوده و یا این‌که «هدفمند» بودن جزو عناصر ذاتی شکنجه محسوب نمی‌شود. البته این رویکردها در عین متفاوت بودن، با یکدیگر مغایرت ندارند، یعنی همان‌گونه که برخی از مراجع قضایی و شبه قضایی مطرح کرده‌اند، این تفاوتها می‌توانند با اتخاذ یک رویکرد آزادمنشانه  و موسع مکمل یکدیگر باشند؛ البته این ایده‌آل است، ‌ولی واقعیت این است که اگر مراجع قضایی و شبه‌قضایی چنین شیوه‌ای را اتخاذ ننمایند،‌ بالقوه این ظرفیت وجود دارد تا با اتخاذ رویکردهای متفاوت، فهم و استنباط‌های متفاوتی از اصطلاح «شکنجه» در صحنه بین‌المللی رواج یابد و این امر موجب تضعیف مفهوم و مبارزه با چنین رفتارهایی شود.}, keywords_fa = {}, url = {https://www.cilamag.ir/article_17976.html}, eprint = {https://www.cilamag.ir/article_17976_7f3895629f0cca91636ceaf7e599475b.pdf} }
