The fact that the internet records everything and forgets nothing, is inconsistent with the fragility of human memory. For this reason, a debate about the need to regulate the ‘right to be forgotten’ that builds on the rights of the personality, consisting several elements such as the right to privacy, data protection, and dignity has emerged in Europe. This right which finds its rationale in the protection of privacy gives individuals the possibility to remove information about them from the Internet. Moreover, the right to be forgotten could become incompatible with other traditionally protected rights such as freedom of expression and access to information. This paper explains the history of the recognition of the right to be forgotten which has been defined basically by Data Protection Agencies and studies a new European framework for data protection.}, keywords = {Data Protection,human rights,Privacy,Right to be Forgotten,Cyberspace,Directive on Data Protection 1995,The European Court of Justice Judgment on 13th May 2014}, title_fa = {حقوق بشر و حق بر فراموش‌شدن در عصر فناوری‌های نوین اطلاعاتی}, abstract_fa = {این مقاله به دنبال شفاف‌سازی دیدگاه‌ها راجع به یکی از چالش‌های مهمی است که در پی پیدایش و گسترش اینترنت و وب 2.0 در حوزه حریم خصوصی و حمایت از داده‌ها پدیدار شده است. این واقعیت که در جهان اینترنت، همه‌چیز به خاطر سپرده شده و هیچ‌چیز فراموش نمی‌شود، در تعارض با حافظه شکننده بشری است. در همین راستا، در جامعه اروپا بحث راجع به نیاز به مقررات‌گذاری درباره«حق بر فراموش‌شدن» شکل‌گرفته که مبنای آن، حقوق شخصیت و عناصری چون حق بر حریم خصوصی، خلوت و حمایت از داده است. به‌موجب این حق که ریشه در حق بر حریم خصوصی دارد، افراد می‌توانند خواستار حذف اطلاعاتشان در اینترنت و ‌فراموش‌شدن آن شوند. از سوی دیگر، ممکن است حق بر فراموش‌شدن با سایر حقوق اساسی که به‌طور سنتی مورد حمایت قرار گرفته‌اند نظیر آزادی بیان و دسترسی به اطلاعات، در تعارض قرار گیرد. این مقاله به تاریخچه، تعریف و شناسایی حق بر فراموش‌شدن که بنیان و اساس آن توسط آژانس‌های حمایت از داده پی‌ریزی شده می‌پردازد و چارچوب اروپایی جدید در حوزه حمایت از داده را بررسی می‌کند.}, keywords_fa = {حمایت از داده,حریم خصوصی,حق بر فراموش‌شدن,فضای مجازی,دستورالعمل حمایت از داده 1995,رأی 13 مه 2014 دیوان دادگستری اروپا}, url = {https://www.cilamag.ir/article_23525.html}, eprint = {https://www.cilamag.ir/article_23525_913aad7d4b566f1a3f66856578e143ab.pdf} }
