There is a fundamental resemblance between granting nationality to ships and granting nationality to the natural persons by a State. On the matter of granting nationality to a natural person, there should be a genuine link between the granting States and the receiving person. In case of a lack of a genuine link between the State and person, other States may refuse to recognize the nationality given by a State on the basis of the judgment of the International Court of Justice. A great majority of the ships operating in international shipping lack a genuine link with their Flag States amounting to a lack of jurisdiction and effective control on the ship by the Flag State and violation of the international regulations by such ships. This paper examines the possibility of applying the genuine link doctrine on the shipping industry and the possibility of the other States refusing to recognize the nationality granted to the ship by the Flag States in the case of lack of a genuine link between them.}, keywords = {Genuine Link,Flag State,International Shipping,International Tribunal for the Law of Sea (ITLOS)}, title_fa = {بررسی اعمال دکترین پیوند واقعی در اعطای تابعیت به کشتی توسط کشور صاحب پرچم}, abstract_fa = {تابعیت، یکی از ارکان حقوقی فعالیت کشتی‌ها به شمار می‌رود که کشور صاحب پرچم به کشتی میدهد و کشتی با ثبت در هر کشوری و برافراشتن پرچم آن کشور، تابعیت آن را به دست می‌آورد. اعطای تابعیت به کشتی، شباهت‌های بنیادینی با اعطای تابعیت به اشخاص حقیقی دارد. در مبحث اعطای تابعیت کشورها به اشخاص حقیقی ‌باید بین کشور اعطاکنندة تابعیت و شخص پذیرنده آن، «پیوند واقعی»[1] وجود داشته باشد و در صورت فقدان آن، کشورها می‌توانند بر اساس رأی دیوان بین‌المللی دادگستری از شناسایی تابعیت اعطاشده خودداری کنند. در حال حاضر، بسیاری از کشتی‌های فعال در عرصه حمل‌ونقل دریایی با کشور متبوع خود «پیوند واقعی» نداشته و همین امر باعث عدم حاکمیت و کنترل مؤثر کشور صاحب پرچم بر کشتی‌های تحت پرچم خود شده و در نتیجه بسیاری از مقررات بین‌المللی توسط این کشتی‌ها نقض می‌شود. در این مقاله، عدم امکان تعمیم دکترین پیوند واقعی به کشتی‌ها و عدم امکان خودداری از شناسایی تابعیت اعطاشده توسط کشور صاحب پرچم به کشتی در صورت فقدان پیوند واقعی با کشتی تحت پرچم بررسی شده است. 1.Genuine Link}, keywords_fa = {پیوند واقعی,کشور صاحب پرچم,کشتی,کشتیرانی بین‌المللی,دادگاه بین‌المللی حقوق دریاها}, url = {https://www.cilamag.ir/article_36938.html}, eprint = {https://www.cilamag.ir/article_36938_d47e53e57e205d5e7c181c9a5d4b3151.pdf} }
