Accordingly, in the contemporary era, Westphalian sovereignty is far from its concept and it is no longer the absolute power and today is considered as responsibility. Human rights and globalization are two phenomena that have eroded national sovereignty. Human rights and the international focus on it has debilitated the principle of non-intervention in the internal affairs of States so that governments have been forced to adapt its sovereignty with human interests. Moreover, the phenomenon of globalization has taken the monopoly of States governance in an international sphere and leads to global governance. In this paper, it is tried to first discuss the concept of sovereignty and its transformation in international law, and then it is considered in the context of the next development in the framework of the principle of non-intervention and globalization.}, keywords = {Sovereignty,International Law,The Principle of Non-Intervention,Globalization,Global governance}, title_fa = {فرسایش حاکمیت ملی در حقوق بین‌الملل معاصر:از حاکمیت اقتدارگرا به سوی حاکمیت مشروط}, abstract_fa = {حاکمیت به‌عنوان قدرت عالی سیاسی حکومت‌داری، در طول زمان متحول شده و همگام با مقتضیات زیست بشری به سوی کمال در حرکت بوده است. بر این اساس در دوران معاصر، حاکمیت از مفهوم وستفالیایی خود بسیار دور شده و دیگر آن قدرت مطلق سرکش نیست و امروزه به مثابه مسئولیت انگاشته می‌شود. حقوق بشر و جهانی‌شدن دو پدیده‌ای هستند که موجب فرسایش حاکمیت ملی شده‌اند. حقوق بشر و توجه جهانی به آن، اصل عدم مداخله در امور داخلی کشورها را نشانه رفته است، به‌طوری که دولت‌ها مجبور شده‌اند حاکمیت ملی خود را با منافع بشر تطبیق دهند. همچنین پدیده جهانی‌شدن، انحصار حکمرانی را از دولت‌ها در نظام بین‌المللی گرفته است و موجبات حکمرانی جهانی را در آینده فراهم می‌آورد. در این مقاله، مفهوم حاکمیت، تحول آن در حقوق بین‌الملل و در چارچوب اصل عدم مداخله و جهانی‌شدن بررسی می‌شود.}, keywords_fa = {حاکمیت,حقوق بین‌الملل,اصل عدم مداخله,جهانی‌شدن,حکمرانی جهانی}, url = {https://www.cilamag.ir/article_36939.html}, eprint = {https://www.cilamag.ir/article_36939_37f872f68023572d7645438450472fb0.pdf} }
