In other words and in contrast with arbitration agreement, an A.D.R agreement may not cause the jurisdiction of governmental courts or arbitration tribunals to be rejected. Then parties may refer their claim to governmental courts and/or arbitration resource (in case of any arbitration agreement) while ignoring the A.D.R agreement. However, this condition is under adjustment. In most cases national courts and arbitration tribunals with respect to parties agreement have rejected their temporary jurisdiction and have pended hearing the cases based upon the necessity of taking efforts in friendly settlement of disputes. This paper intends to study any traditional attitude of most governmental courts and arbitration tribunals in ignoring their jurisdiction and denying hearing any claims in case of an A.D.R agreement.}, keywords = {شیوه‌های جایگزین حل و فصل اختلاف (ای.‌دی.‌آر),دادگاه دولتی,موافقتنامه داوری,موافقتنامه‌ ای.‌دی.‌آر,داوری}, title_fa = {نفی صلاحیت دادگاه‌های دولتی و مراجع داوری در صورت وجود موافقتنامه ای.‌دی.‌آر با تأکید بر نظام حقوقی کامن‌لا و رویه داوری‌های بین‌المللی}, abstract_fa = {در مورد شیوه‌های جایگزین (غیرقضایی) حل و فصل اختلاف که اصطلاحاً با عنوان ای.‌دی.‌آر شناخته می‌شوند قاعده اصلی و سنتی این بوده است که توافق طرفین در ارجاع اختلاف به شیوه‌های مزبور، مانع از رسیدگی دادگاه‌های دولتی یا مراجع داوری نخواهد بود. به عبارت دیگر، موافقتنامه ای.‌دی.‌آر برخلاف موافقتنامه داوری، موجب نفی صلاحیت دادگاه دولتی یا مرجع داوری نمی‌شود و هر‌یک از طرفین می‌تواند با نادیده‌گرفتن موافقتنامه ای.‌دی.‌آر دعوای خود را در دادگاه دولتی و‌یا مرجع داوری (در صورت وجود موافقتنامه داوری) مطرح سازد. با وجود این، وضعیت مزبور در حال تعدیل شدن است و در موارد متعدد، دادگاه‌های ملی و مراجع داوری با احترام به توافق طرفین و با نفی صلاحیت موقتی خود، شروع رسیدگی‌ها را معلق بر انجام رسیدگی‌ها و تلاش‌ها جهت حل و فصل دوستانه اختلاف طبق روش مورد توافق دانسته‌اند. این مقاله تغییر نگرش سنتی پاره‌ای از دادگاه‌های دولتی و مراجع داوری را در نفی صلاحیت از خود و عدم استماع دعوا در صورت وجود موافقتنامه ای.‌دی.‌آر مورد بررسی قرار می‌دهد.}, keywords_fa = {شیوه‌های جایگزین حل و فصل اختلاف (ای.‌دی.‌آر),دادگاه دولتی,موافقتنامه داوری,موافقتنامه‌ ای.‌دی.‌آر,داوری}, url = {https://www.cilamag.ir/article_16900.html}, eprint = {https://www.cilamag.ir/article_16900_553c9d5f3f66da1b29c7810179fe910b.pdf} }
