Article5 (1)(d) of the statute, has recognized jurisdiction over the crime  of aggression. But article 5 (2) has predicted that exercising jurisdiction over this crime will begin when according to articles 121 and 123 of the statute, regulations about definition and conditions for exercise of jurisdiction over the crime of aggression is approved. Finally, on 11 June 2010, the first Review Conference of the Rome Statute after hot and long discussions and negotiations within preliminary commission for establishing court and special working group on the crime of aggression has passed resolution RC/Res.6 (adopted at the 13th plenary meeting, on 11 June 2010, by consensus). However, the court shall exercise jurisdiction over the crime of aggression, subject to a decision to be taken after 1 January 2017. Some questions are arising here, what are aggression and elements of it? What are conditions for exercise of jurisdiction over the court? What is the Security Council’s role in determination of aggression?  This paper will have a brief view on the international measures that have resulted in convening of the Kampala Agreement and will explain the definition, elements and conditions for exercise of jurisdiction with respect to the crime of aggression}, keywords = {definition,conditions,aggression,Crime,Kampala Agreement,first review conference,Security Council,Consensus}, title_fa = {تعریف، عناصر و شروط اعمال صلاحیت دیوان بین‌المللی کیفری نسبت به جنایت تجاوز «با نگاهی به موافقتنامه کامپالا»}, abstract_fa = {در واپسین روزهای کنفرانس رم که به تصویب اساسنامه دیوان بین‌المللی کیفری منجر شد تعریف جنایت تجاوز و شرایط اعمال صلاحیت دیوان نسبت به آن به کنفرانس بازنگری محول شد که هر هفت سال یک بار بعد از لازم‏الاجرا شدن اساسنامه تشکیل می‏شود. ماده 5 (1)(د) اساسنامه رم، صلاحیت دیوان درخصوص رسیدگی به جنایت تجاوز را به رسمیت شناخت؛ لکن بند 2 ماده 5 دیوان پیش‏بینی کرد که دیوان زمانی بر این جنایت اعمال صلاحیت می‏کند که مطابق مواد 121 و 123 اساسنامه، مقررات مربوط به تعریف تجاوز و شروط اعمال صلاحیت دیوان نسبت به آن تصویب شده باشد.  سرانجام در 11 ژوئن 2010 نخستین کنفرانس بازنگری دیوان بین‌المللی کیفری بعد از سال‏ها بحث و گفتگوهای مفصل درچارچوب کمیسیون مقدماتی برای تشکیل دیوان و گروه کاری ویژه درخصوص جنایت تجاوز، قطعنامه شماره 6 را درخصوص تعریف جنایت تجاوز، عناصر آن و شروط اعمال صلاحیت دیوان با اجماع تصویب کرد. با وجود این، اعمال صلاحیت واقعی دیوان، به تصمیم کشورهای عضو بعد از اول ژانویه 2017 موکول گردیده است. اینک سؤال اصلی این است که تعریف جنایت تجاوز و عناصر سازنده آن چیست؟ شرایط اعمال صلاحیت دیوان کدامند؟ نقش شورای امینت در احراز جنایت تجاوز چگونه تعیین شده است؟ اصلاحات کنفرانس بازنگری در کامپالا تا چه حد توانسته، به فرهنگ مصونیت پایان بخشد؟ مروری بر اقدامات بین‏المللی که منجر به انعقاد موافقتنامه کامپالا گردید و نیز تبیین تعریف، عناصر و شروط اعمال صلاحیت دیوان نسبت به جنایت تجاوز موضوع نوشته حاضر است.}, keywords_fa = {جنایت تجاوز,صلاحیت تکمیلی موافقتنامه کامپالا,دیوان کیفری بین‌المللی}, url = {https://www.cilamag.ir/article_17166.html}, eprint = {https://www.cilamag.ir/article_17166_b5fe4216f9aa4b587fa8a5603af604fb.pdf} }
