As a result of the emergence of these difficulties and worsening situation, UN Security Council issued several resolutions under Chapter 7 of UN Charter and determined that the incidents of piracy and armed rubbery at sea in the waters of the coast of Somalia exacerbate the situation in Somalia which continues to constitute a threat to international peace and security in the region. Although, these resolutions frequently declared that the states extraordinary rights and duties in this regard shall not be considered as establishing a customary international law, but states practices especially in arrest, prosecution and trial of pirates are going to establish a new international law on combating piracy which is beyond the 1982 Convention on the Law of the Sea.}, keywords = {Piracy,international community,Convention on the Law of the Sea,International Peace and Security,International Maritime Organization}, title_fa = {تحلیل عملکرد جامعه بین‌المللی در پاسخ به اقدامات دزدان دریایی در سواحل سومالی و خلیج عدن}, abstract_fa = {به‌دنبال فروپاشی دولت سومالی در دهه 1990 و در نتیجه، افزایش حملات دزدان دریایی به کشتی‌های تجـاری و غیـرتجاری حامل کمک‌های بشردوستـانه بـه مردم سومـالی، جامعه بین‌المللی با مشکلات عدیـده‌ای روبـه‌رو شده است. متـأثر از این مشکلات و بحرانی شدن وضعیت، شورای امنیت سازمان ملل متحد قطعنامه‌های متعددی براساس فصل 7 منشور ملل متحد صادر کرده و عنوان می‌دارد که رخدادهای دزدی دریایی و سرقت مسلحانه در آب‌های سواحل سومالی، وضعیت سومالی را وخیم‌تر کرده که ثمره آن، تهدید صلح و امنیت بین‌المللی در این منطقه است. هرچند این قطعنامه‌ها به‌کرات اعلام می‌دارند که حقوق و تکالیف غیرمعمول مذکور در آن‌ها، موجد حقوق بین‌الملل عرفی نخواهند بود، با این حال عملکرد دولت‌ها بخصوص در مورد دستگیری، تعقیب و محاکمه دزدان دریایی به سمت ایجاد حقوق بین‌المللی نوینی در مبارزه با دزدان دریایی است که به‌نظر فراتر از کنوانسیون 1982 حقوق دریاها است. }, keywords_fa = {دزدی دریایی,کنوانسیون 1982 حقوق دریاها,سازمان دریانوردی بین‌المللی,صلح و امنیت بین‌المللی,جامعه بین‌المللی}, url = {https://www.cilamag.ir/article_17291.html}, eprint = {https://www.cilamag.ir/article_17291_c62a26bd21afb3b98ffcaa28fe935aff.pdf} }
