In This religion, war has been legalized to defend individual, national and human rights. In accordance with the political Islamic jurisprudence, the contracts of obligation (Thimmah), Security (Amān) Case Fire (Hodneh), Peace (Solh) and Arbitration (Tahkīm) are Considered as the ways of putting an end to a war. A Contract of obligation (Thimmah) is one that is held between the Islamic government and the followers of the book (Ahl-al-ketab). This Contract is always valid, even though a cruel or unjust ruler in Islamic world would have signed it. With this, the Islamic government is obliged to defend the followers of the book against any aggressor. With the Contract of security (Amān), life, finances and respect of the infidels who have fighted against Muslims, will be in Safe. The scope of this contract is not limited to the war period, but it may conclude other elements as temporary residence, touristic journeys, etc … in an Islamic Country. (Hodneh), namely, Cease fire, truce and Armistice is a Contract which is the most prevalent way of bringing a war to an end in our age. But it is temporary and not, necessarily, permanent. The contract of peace (Solh) differs from the latter’s, although its fundamental characteristic is to be permanent, and not temporary but, it is still a matter of discussion in political jurisprudence. The Contract of Arbitration (Tahkīm) allows hostilities to be settled by an impartial body.}, keywords = {}, title_fa = {راههای پایان دادن جنگ در حقوق اسلام}, abstract_fa = {دین اسلام، منادی صلح است و جنگ در این مکتب به هدف دفاع از حقوق فردی، ملی و انسانی تشریع شده است. از نگاه فقه سیاسی، قرارداد ذمّه، امان، هدنه، صلح و تحکیم، راههای پایان جنگ محسوب می‌شوند. ذمّه، قراردادی است که دولت اسلامی با اهل کتاب منعقد می‌کند. این قرارداد در هر عصری محکوم به صحت است حتی اگر حکام جور آن را منعقد کرده باشند. دولت اسلامی پس از امضای این قرارداد، متعهد می‌شود تا در برابر هر متجاوزی از آنان دفاع کند. با قرارداد امان، جان و مال و عِرض کفّار حربی از هرگونه تعرّضی مصون می‌شود. دامنة امان به زمان جنگ محدود نمی‌شود بلکه ممکن است به اهداف دیگری مانند اقامت و توطّن موقّت در ممالک اسلامی، سیر و سیاحت و غیره منعقد شود. هدنه که مترادف آتش‌بس، متارکه و ترک مخاصمه است، شایع‌ترین راه پایان دادن جنگ در عصر کنونی محسوب می‌شود. با هدنه گرچه جنگ به طور موقّت پایان می‌یابد ولی حالت جنگ همچنان باقی خواهد ماند. عقد صلح، جدای از هدنه، امان، ذمّه و تحکیم است. گرچه ویژگی صلح، دائمی بودن آن است اما موقّت یا دائمی بودن صلح در فقه سیاسی، محل بحث و گفتگو است. در تحکیم، مخاصمات با ارجاع به شخص ثالث پایان می‌یابد.  }, keywords_fa = {}, url = {https://www.cilamag.ir/article_18028.html}, eprint = {https://www.cilamag.ir/article_18028_c509454c1b934e2947c8c926e7362a1f.pdf} }
