However, in the international criminal law unlike private international law, because of protection of sovereignty of states, we cannot decisively answer to this question and there is no solution of conflict laws, but we can find out some cases that one court withdraws its sovereignty rights and proclaims that other courts are competent to persecute and investigate the cases, thus conflict of jurisdiction can be solved or would be prevented ab initio in such a conflict. Nevertheless, there are rules and solutions in the scope of international criminal law that can be used for solving conflicts or prevention of conflict of jurisdictions; solutions such as preferable jurisdiction, “aute dedere aute judicare” rule, extradition of criminals, non bis in idem, transferring of criminal proceeding and etc. have been discussed in this paper, beside the explanation of this solutions, we submit some proposal in order to resolving conflict of jurisdictions.}, keywords = {Jurisdiction,Court,Conflict,International Criminal Law}, title_fa = {راه‌حل‌های تعارض صلاحیت در قلمرو حقوق جزای بین‌الملل}, abstract_fa = {به دلیل وجود صلاحیت سرزمینی و فراسرزمینی و درگیرشدن افراد در فعالیت‌هایی که مرزهای سیاسی را درنوردیده، ممکن است وقوع عمل مجرمانه در سرزمین یک دولت، با لحاظ عناصر بین‌المللی، منجر به اختلاف دو یا چند دولت یا حتی دادگاه‌های بین‌المللی در ادعای اعمال صلاحیت بر اساس اصول مختلفی شود. در این حال، کدام دادگاه داخلی یا بین‌المللی، صلاحیت رسیدگی دارد؟ هرچند در حقوق جزای بین‌الملل به‌خاطر حفظ حاکمیت دولت‌ها برخلاف حقوق بین‌الملل خصوصی، نمی‌توان پاسخ قاطعی به این سؤال داد و قاعده حل تعارض وجود ندارد، می‌توان مواردی را یافت که دادگاه، دست از اصول حاکمیتی خود کشیده و دادگاه دیگری را صالح می‌داند و بدین ترتیب، تعارض صلاحیت، حل شده یا مانع شکل‌گیری چنین تعارضی خواهد شد. باوجود این، قواعد و راه‌حل‌هایی در قلمرو حقوق جزای بین‌الملل وجود دارد که می‌توان از آن‌ برای حل تعارض یا پیشگیری از وقوع تعارض صلاحیت استفاده کرد. راه‌حل‌هایی همچون صلاحیت برتر، قاعدة «یا محاکمه کن یا مسترد کن»، استرداد مجرمین، منع تعقیب مجدد، احاله دادرسی کیفری و ... مطرح شده که در این مقاله، ضمن بیان این راه‌حل‌ها، پیشنهادهایی برای حل تعارض صلاحیت ارائه خواهد شد.}, keywords_fa = {صلاحیت,دادگاه,تعارض,حقوق جزای بین‌الملل}, url = {https://www.cilamag.ir/article_27972.html}, eprint = {https://www.cilamag.ir/article_27972_d8e49d5034591f8934bf60c2164791fa.pdf} }
