Given that many of such disputes involve parties from different countries and intellectual properties arising under the laws of more than one country, the parties to the dispute may find it undesirable or cumbersome to recourse to national courts. In particular, the territorial nature of intellectual property renders these disputes incapable of being resolved on an international basis. The multiplicity of litigation proceedings is susceptible to serious inconsistencies coupled with uncertainty and expense of enforcing foreign judgments in certain jurisdictions. International arbitration, as an interesting alternative to court litigation, can offer genuine advantages to settle intellectual property disputes. Yet, in many legal systems, the arbitrability of intellectual property disputes has been far from settled. Since Intellectual property rights are in fact monopolies granted by States and many of them must be registered with a State authority if they are to subsist, the question of whether parties can validly submit intellectual property disputes to arbitration has given rise to a historical national resistance to arbitration of intellectual property disputes in general and registered intellectual property disputes in particular. Today, national legal systems tend to take different approaches to this issue; from excluding arbitration on registered intellectual property disputes together with recognizing full arbitrability of all disputes concerning registered intellectual property rights. Nevertheless, a comparative study of modern legal systems and their developments shows that the prevailing trends are shifting toward making most intellectual property disputes arbitrable.    }, keywords = {Keywords: Arbitration,Registered Intellectual Property Rights,Disputes Concerning Intellectual Property Rights,Arbitrability,Validity,Ownership,Infringement,Exploitation}, title_fa = {قابلیت داوری دعاوی حقوق مالکیت فکری نیازمند ثبت}, abstract_fa = {چکیده حضور روزافزون دارایی‌های فکری در دنیای کنونی تجارت بین‌الملل، موجب افزایش ناگزیر دعاوی بین‌المللی حقوق مالکیت فکری بین اشخاص خصوصی شده است. ازآنجا‌که در بسیاری از موارد، حق فکریِ موضوع اختلاف و اطراف دعوا با چند نظام حقوقی در ارتباط است، رجوع به دادگاه‌های ملی برای حلّ این اختلافات، دشواری‌ها و ناکارآمدی‌هایی را به همراه خواهد داشت. به‌طور خاص، خصلت سرزمینی حقوق مالکیت فکری، مانع از حل‌و‌فصل قضایی اختلافات ناظر به این حقوق در سطح بین‌المللی می‌شود. چندگانگی رسیدگی قضایی به این دعاوی با خطرات جدّی چون ناهماهنگی‌ و تضاد در آرای قضایی مختلف و البته دشواری اجرای احکام قضایی خارجی مواجه است. داوری بین‌المللی به‌عنوان شیوه‌‌‌ای جایگزین برای رسیدگی قضایی، مزایای قابل‌توجهی در حل‌و‌فصل اختلافات بین‌المللی حقوق مالکیت فکری دارد. بااین‌حال، در بسیاری از نظام‌های حقوقی، داوری‌پذیری دعاوی حقوق مالکیت فکری محل مناقشه است. ازآنجا‌که حقوق مالکیت فکری، حقوق انحصاری است که حاکمیت اعطا میکند و شرط حمایت از بسیاری از آن‌ها، ثبت نزد مقامات عمومی است، بحث قابلیت داوری این دعاوی، و به‌طور خاص، دعاوی مربوط به حقوق مالکیت فکریِ ثبت‌شده، در طول تاریخ، شاهد نوعی بدبینی و مقاومت در نظام‌های حقوقی ملی بوده است. امروزه مواضع نظام‌های حقوقی دنیا در برابر داوری‌پذیری این دعاوی در طیف گسترده‌ای قرار می‌گیرد: از ممنوعیت مطلق داوری دعاوی حقوق مالکیت فکری ثبت‌شده تا پذیرش کامل داوری دعاوی ناظر به این حقوق. بااین‌حال، مطالعه تطبیقی نظام‌های حقوق پیشرفته و تحولات آن‌ها بیانگر وجود جریانی برای پذیرش حداکثری داوری دعاوی حقوق مالکیت فکری است.      }, keywords_fa = {داوری بین‌المللی,حقوق مالکیت فکری ثبت‌شده,دعاوی حقوق مالکیت فکری,اعتبار,مالکیت,نقض,بهره‌برداری}, url = {https://www.cilamag.ir/article_31682.html}, eprint = {https://www.cilamag.ir/article_31682_f1a959548d61e226c97c199cbbcb22c1.pdf} }
