In these clashes, chemical weapons were used, the most important of which happened on 21August 2013, with more than 1,400 people killed. Legally speaking, it was argued whether the use of chemical weapons (CW) in the internal conflicts of Syria was considered an international crime under the Court’s jurisdiction, in light of the fact that the use of CW was not counted as a crime in the Statute of the International Criminal Court (ICC); and is it possible for the Court to exercise jurisdiction over Syria's situation in light of the fact that Syriais not a party to the Rome Statute of the International Criminal Court? In this paper, the researchers have considered the use of CW in Syria's internal conflicts as a war crime, by analyzing the subject, interpreting the Statute and applying it to elements of the crimes under the jurisdiction of the ICC. Also, the study indicates that, according to the amendments to the Statute of the ICC in Kampala, Uganda, in June 2010, if the Security Council refers the "situation" of Syria to the ICC, it will be possible for the Court to exercise its jurisdiction.}, keywords = {Chemical Weapons,Syria’s Internal Conflicts,war crimes,International Criminal Court,Jurisdiction}, title_fa = {امکان تعقیب به‌کارگیری سلاح شیمیایی در سوریه توسط دیوان بین‌المللی کیفری}, abstract_fa = {جمهوری عربی سوریه از ابتدای 2011 (دی 1389) صحنه اعتراضات سیاسی بود که خیلی زود به درگیری‌های مسلّحانه داخلی تبدیل شد. در این درگیری‌ها سلاح شیمیایی استفاده شد. مهم‌ترین موارد آن، یکی 21 اوت 2013 (30 مرداد 1392) بود که در اثر آن، حدود 1400 نفر کشته شدند و دیگری 4 آوریل 2017 (15 فروردین 1396) بود که حدود 100 کشته و 400 مجروح برجای گذاشت. به لحاظ حقوقی این بحث مطرح شد که با توجه به عدم برشمردن «استفاده از سلاح شیمیایی» به‌عنوان جنایت در اساسنامه دیوان بین‌المللی کیفری، آیا استفاده از سلاح شیمیایی در درگیری‌های داخلی سوریه، جنایت بین‌‌‌المللی تحت صلاحیت دیوان محسوب می‌شود؟ و آیا با توجه به عدم عضویت سوریه در اساسنامه دیوان بین‌المللی کیفری، این دادگاه می‌تواند نسبت به وضعیت سوریه اِعمال صلاحیت کند؟ محققین در این مقاله با تحلیل موضوع، تفسیر اساسنامه و تطبیق آن با عناصر جنایات تحت صلاحیت دیوان، به‌کارگیری سلاح شیمیایی در مخاصمات داخلی سوریه را مصداق جنایت جنگی دانستند. همچنین بررسی‌های پژوهش نشان می‌دهد، با توجه به اصلاحات اساسنامه دیوان در کامپالای اوگاندا در ژوئن 2010 (خرداد 1389)، در‌ صورتی ‌که شورای امنیت، «وضعیت» سوریه را به دیوان ارجاع دهد، اِعمال صلاحیت دیوان بین‌المللی کیفری بر آن امکان‌پذیر است.}, keywords_fa = {سلاح شیمیایی,مخاصمات داخلی سوریه,جنایت جنگی,دیوان بین‌المللی کیفری,صلاحیت}, url = {https://www.cilamag.ir/article_35078.html}, eprint = {https://www.cilamag.ir/article_35078_c81d2c1d33b295475e5ecd9995573313.pdf} }
