It is generally accepted that resort to force in self - defence is lawful under contemporary international law, but several doctrines have been advanced in recent decades as to the meaning and scope of this right. Some legal scholars and states representatives favour an expanded interpretation of the right of self - defence. It is certainly true that September 11 generated a new dimension in legal and political discourse. The International Court of Justice after 9/11 dealt with disputes involving the use of force, allegedly in self - defence, in the case concerning oil platforms, the Palestinian Wall advisory opinion and the Armed Activities case. We conclude that the ICJ reaffirmed and outlined the conditions for the legitimate use of self - defence established in the Nicaragua case, namely the existence of an armed attack; proportionality and necessity of the actions taken, and employment of force in self – defence against a military target. The court strengthened the condition of an armed attack, on the basis of treaty and customary law, thereby opting for a restrictive interpretation of the right of self - defence. دامنه و حدود توسل به زور در روابط بین‌المللی، حتی در هزاره سوم میلادی، موضوع بحث‌های گسترده‌ای بوده است. علی‌الاصول توسل به دفاع مشروع به موجب حقوق بین‌الملل معاصر پذیرفته شده است. با وجود این، طی دهه‌های اخیر، آموزه‌هایی در‌خصوص مفهوم و دامنه این حق مطرح شده‌اند. برخی حقوقدانان و کشورها، گرایش خود را به تفسیری موسع از حق دفاع مشروع نشان داده‌اند. رویداد یازدهم سپتامبر 2001، بعد جدیدی را در گفتمان حقوقی و سیاسی مطرح کرد. پس از رویداد مذکور، دیوان بین‌المللی دادگستری به اختلافاتی که از جمله شامل ادعای توسل به دفاع مشروع نیز بود، در قضایای سکوهای نفتی، نظریه مشورتی دیوار حائل و فعالیت‌های مسلحانه در سرزمین کنگو رسیدگی کرد. در نتیجه، دیوان شرایط توسل به دفاع مشروع را که در قضیه نیکاراگوئه احراز کرده بود، یعنی وجود حمله مسلحانه، تناسب، ضرورت اقدام دفاعی و توسل به دفاع مشروع علیه یک هدف نظامی، مجدد تأیید و ترسیم کرد. دیوان شرایط یک حمله مسلحانه را بر مبنای حقوق قراردادی و عرفی تبیین کرده، از این طریق، تفسیری مضیق از حق دفاع مشروع را برگزید. https://www.cilamag.ir/article_16951_74a14dc6be3d469770f53dd3fb93c6c4.pdf
