Rather, they try to perform their judicial function and in so doing they adopt different approaches to maintain an equilibrium between the requirements of the international community, on the one hand, and the wishes of the disputing parties, on the other. The choice of these approaches to a large extent depends on the underlying ‘judicial policy’ of each tribunal which can, in turn, be distilled out of the <em>jurisprudence</em> <em>constante</em> of that tribunal. During its lifetime, the International Court of Justice has generally strived to stay in harmony with the needs of the contemporary international community to perform its judicial function in the best way possible. Thus, in times in which the international community was experiencing crisis or instability, the Court has attempted to adopt a rather passive judicial policy (judicial restraint.) Conversely, in times of stability, it has tried to adopt a proactive judicial policy. However, due to the special circumstances of each case, the Court has sometimes shown more affinity to one of these approaches. محاکم بین‌المللی در مواجهه با قضایای مختلف و اوضاع و احوال گوناگون در جامعة بین‌المللی همواره به شکلی واحد برخورد نمی‌کنند. در عوض، محاکم بین‌المللی می‌کوشند تا با به‌کارگرفتن رویکردهای مختلفی به اشتغال قضایی خود بپردازند و از این طریق میان مقتضیات جامعة بین‌المللی از یک سو، و خواست طرفین اختلاف از سوی دیگر تعادلی برقرار کنند. اتخاذ این رویکردها به «سیاست قضاییِ» هر محکمه بستگی دارد که به نوبة خود باید از دل رویه­قضایی آن استخراج شود. دیوان بین‌المللی دادگستری در طول حیات خود کوشیده است تا با درنظرگرفتن جامعة بین‌المللیِ هر عصر، خود را با نیازهای روز آن هماهنگ سازد تا بتواند اشتغال قضایی خود را به بهترین نحو به انجام رساند. در این مسیر، دیوان در دوران‌هایی که جامعة‌ بین‌المللی دچار بی‌ثباتی بوده، تلاش کرده است بیشتر به رویکرد «منفعل» و «احتیاط قضایی» نزدیک شود؛ و در مقابل، در دوران‌های ثبات به رویکرد «فعال» و «کنش‌گری قضایی» بپردازد؛ گرچه دیوان گاه به جهت وجود مقتضیات خاص و موردی نیز بنا به مورد به یکی از این رویکردها بیشتر قرابت نشان داده است. https://www.cilamag.ir/article_243892_3c2ac052e849089905265b2f8f9a4c5b.pdf
