Despite the fact that non-governmental organizations are recognized as the subsidiary subjects of international law and their establishment and formation are conducted by private persons and according to the domestic laws of countries, the important status of some of them in the international community has raised many legal issues. One of the issues that will be discussed in this article is whether the aforementioned organizations, similar to international organizations enjoy immunity based on having international legal personality, functionalism or structuralism? As the research hypothesis, it is suggested that for granting immunity to non-governmental organizations, we observe a selective practice of governments toward a few organizations, and the basis of immunity is also explained on a new approach consisting of functionalism and structuralism doctrines. Thus, mixed administration or financing, performing a mission related to the international public interests and official recognition through a multilateral treaty or frequent resolutions of an international governmental organization, are the indicators for granting immunity. نقش سازمان‌های بین‌المللی غیردولتی در نیم­ قرن اخیر ارتقا یافته و حیطة فعالیت ­ها آن‌ها موسع شده است. سازمان­های غیردولتی علی­رغم اینکه در حقوق بین‌الملل به‌عنوان تابعان فرعی شناخته می‌شوند و بنای تأسیس و شکل‌گیری آن‌ها توسط اشخاص خصوصی و به موجب قوانین داخلی کشورهاست، اما جایگاه مهم و عملکردتأثیرگذار برخی از آن‌ها در جامعة بین­المللی موجد طرح مسائل حقوقی متعدد شده است. ازجمله در مقاله به این موضوع پرداخته خواهد شد که آیا سازمان­ های مذکور، مشابه سازمان­های بین ­المللی بر مبنای برخورداری از شخصیت حقوقی بین ­المللی، کارکردگرایی یا ساختارگرایی، برخوردار از مصونیت هستند یا خیر؟ در پاسخ به سؤال فوق و به‌عنوان فرضیة تحقیق، مطرح است که در مورد اعطای مصونیت به سازمان­ های بین ­المللی غیردولتی، دولت­ها در رابطه با معدودی از سازمان ­ها عملکرد گزینشی دارند و در مورد مبنای مصونیت نیز رهیافت جدیدی مشتمل بر کارکردگرایی و ساختارگرایی مطرح است. به این ترتیب، مختلط­ بودن اداره یا تأمین مالی، ایفای مأموریتی مرتبط با منافع بین ­المللی عمومی و شناسایی رسمی در چارچوب یک معاهده چندجانبه یا قطعنامه‌های مکرر یک سازمان­ بین­ المللی دولتی ازجمله شاخص ­های اعطای مصونیت مطرح هستند.  https://www.cilamag.ir/article_707228_9da04c4e12a2e0938a7ba56e6a02a76a.pdf
