However, the question raised here is how the court has interpreted and explained the concept of the best interests of the child related to right to family life in asylum procedures? It seems that the Court has interpreted Article 8 of the European Convention on Human Rights with regard to the exceptions mentioned in these articles. In this regard, interpretation of Article 8, the court states that a child may be deprived of the right to family life if his/her or others' rights and freedoms are in danger; However, this deprivation of the right only in time may be in line with the principle of the best interests of the child: First of all, this deprivation is done without discrimination; second, the deprivation must be necessary; and third, the act of restricting the right to family life is proportional to the rights and freedoms that have been taken away from others<span dir="RTL" lang="AR-SA">.</span> <span lang="FA">با توجه به گسیل گستردة پناهجویان به اتحادیة اروپا در سال­های اخیر و با درنظرداشتن این نکته که مصالح عالیة کودک در کلیة اقدام­ها، خصوصاً در رابطه با رویه­های پناهندگی، باید به‌عنوان ملاحظة اولیه در نظر گرفته شود، رویه‌قضایی دیوان اروپایی حقوق بشر در تبیین مفهوم مصالح عالیة کودک در این رویه­ها بسیار پراهمیت تلقی می­شود. اما این سؤال مطرح می­شود که دیوان چگونه مفهوم مصالح عالیة کودک را در رابطه با حق زندگی خانوادگی در رویه­های پناهندگی تفسیر و تبیین نموده است؟ در این رابطه، دیوان ماده 8 کنوانسیون اروپایی حقوق بشر را با توجه به استثنائات مطرح در مورد این ماده تفسیر کرده است. بر همین مبنا، دیوان در تفسیر ماده 8 مبنی بر حق زندگی خانوادگی بیان می­دارد که ممکن است کودک در صورتی‌ که حقوق و آزادی­های دیگران در خطر باشد، از حق زندگی خانوادگی محروم شود؛ با این‌ حال، این محرومیت از حق، صرفاً زمانی ممکن است با اصل مصالح عالیة کودک همسو باشد که اولاً بدون تبعیض صورت پذیرفته باشد؛ ثانیاً ضرورت داشته باشد و ثالثاً عمل محدودنمودن حق زندگی خانوادگی با حقوق و آزادی­هایی که از دیگران سلب شده است، تناسب داشته باشد.</span> https://www.cilamag.ir/article_741085_50d4f9337a82059f3785435d939e6bce.pdf
