Application of International Humanitarian Law in Recent Gaza Conflicts

Abstract

During the three-week conflict in Gaza Strip, basic rules of international humanitarian law have been seriously violated. Among those are violation of “Prohibition of Collective Punishment” and the “Law of Occupation”, “International Humanitarian Law”, and the principle of “Individual Responsibility”, which contains “Aggravated Responsibility” for the Zionist Regime.Whereas international society was expecting states` and main international bodies` reaction to the situation, they didn't get success in decreasing the gravity of situation and also obligating parties failed to observe international humanitarian law. Meanwhile, present international law not only recognizes duties and obligations in this area for the members of international society, but provides means and measures to fulfill those obligations.This article tries to study the situation of observance of international humanitarian law by the Zoinist Regime between 27 December 2008 to 17 January 2009 in Gaza Strip and the international responsibility resulting from.
