روش‌شناسی به مثابه اعمال آموزه‌های مکتب‌محور بر موقعیت‌های عینی در حقوق بین‌الملل

چکیده
پژوهش در حقوق بین‌الملل، ممزوج با الگوهای فکری نهادینه­شده و گاه نااندیشیده است که در ذهن پژوهشگر، بدیهی جلوه می‌کند. روش‌شناسی، ابزاری برای انتخاب آگاهانة الگوی تفکر علمی و عرضة استدلال معتبر بر اساس آن چارچوب است. ازجمله دلالت‌های مفهومی تقریباً ناشناختة روش‌شناسی در ادبیات دانشگاهی کشور، کاربرد این مفهوم به مثابه «اعمال آموزه‌های مکتب‌محور بر موقعیت‌های عینی» است. در این مقاله، متعاقب تبیین دریافت‌های کلاسیک از مفهوم روش‌شناسی، به تبیین محتوا و امتیازات کاربرد روش‌شناسی به مثابه اعمال آموزه‌های مکتبی پرداخته می‌شود تا از این رهگذر، زمینه‌ای برای ترغیب دانش‌پژوهان ایرانی به اتخاذ رویکردهای روش‌شناسانة مکتب­محور در پژوهش‌های حقوقی فراهم شود. افزون بر مورد فوق، با ارائة نمونة آماری در خصوص جایگاه روش‌شناسی تحقیق در رساله‌های دکتری دانشگاه‌‌های دولتی تهران، یافته‌هایی ارائه می‌شود که بر اساس آن می‌توان اظهار داشت در عالی‌ترین پژوهش‌های دانشگاهی کشور نیز مقولة روش‌شناسی از مرتبت شایسته‌ای برخوردار نیست.

چکیده English

Research in international law is mixed with stereotypes and dogmatic beliefs that seem obvious to the researcher. Methodology is a tool for consciously choosing a scientific framework of thinking and presenting authentic reasoning within the framework. Methodology as application of thought school to concrete situations is one of the conceptual implications of methodology that is almost unknown in Iranian academic literature. In this article, following the explanation of the classical perceptions of methodology, the content and advantages of methodology as the application of school are explained. It is hoped that this article provides a basis for encouraging Iranian scholars to adopt thought school methodological approaches in their legal researches. Furthermore, based on a statistical study regarding the dissertations of Ph.D. students of Tehran public universities, it will be argued that even in the best legal researches in Iran, no proper attention has been paid to the methodological issues.
