ارزش حقوقی «دیدگاه های پایانی» کمیته حقوق بشر

چکیده

پروتکل اول منضم به میثاق بین‌المللی حقوق مدنی و سیاسی، مبنای صلاحیت کمیته حقوق بشر در رسیدگی به شکایات افراد علیه دولـت‌های عضو پروتکل درخصوص نقض حقوق منـدرج در میثاق محسوب می‌شود. بـر طبق بنـد چهـار از مـاده پنج پروتکل، کمیته مـوظف شده نتایج رسیـدگی خـود را در قـالب آنچه در ایـن مـاده بـه‌عنوان final views یا «دیدگاه‌های پایانی» نامیده شده، به فرد شاکی و دولت خوانده ارائه کند. با وجود این، سند مذکور هیچ اشاره‌ای به ارزش و جایگاه حقوقی این یافته‌ها و تبعات حاصل از احراز نقض میثاق توسط کمیته ندارد. سؤالی که در این ارتباط مطرح می‌شود این است که آیا «دیدگاه‌های پایانی» کمیته حقوق بشر واجد ماهیت الزام‌آور هستند یا خیر؟ به عبارت دیگر آیا این «دیدگاه‌ها» برای دولت‌های عضو ایجاد الزام می‌کنند یا این‌که صرفاً ارزش توصیه‌ای دارند؟ مقاله حاضر مسأله فوق را بدواً از جنبه نظری و سپس از جنبه عملی و در رویه دولت‌ها مورد بررسی قرار می‏دهد.

The Legal Effects of the Final Views of the Human Rights Committee

Under the Optional Protocol to the International Covenant on Civil and Political Rights, the UN Human Rights Committee has the competence to receive and consider communications from individuals who claim to be victims of violations by a State Party to the Optional Protocol of any of the rights set forth in the Covenant. According to article 5(4) of the Optional Protocol, the Committee shall forward its (final) Views to the State Party concerned and also to the individual. However, the Optional Protocol is silent about the legal effects of these Views. It is unclear whether such Views are binding on the States Parties concerned or they are mere recommendations. The present article examines this issue from a theoretical perspective and in State practice as well.
