بررسی تأثیر احتمالی رأی 30 مارس 2023 دیوان بین‌المللی دادگستری بر رأی آتی دیوان در دعوای نقض‌های ادعایی عهدنامه مودت

چکیده
تأکید چندبارة دیوان بین‌المللی دادگستری بر پایبندی به رویه‌قضایی خود از یک طرف، و مطرح‌شدن نقض مواد متعدد عهدنامة مودت ۱۹۵۵ در دو دعوای برخی اموال ایران و نقض‌های ادعایی عهدنامة مودت از طرف دیگر، این سؤال را به ذهن متبادر می‌کند که یافته‌های دیوان در رأی ماهوی ۳۰ مارس ۲۰۲۳ در دعوای برخی اموال، چه تأثیری بر نتیجة دعوای نقض‌های ادعایی خواهد داشت. این تأثیر احتمالی از دو جهت قابل بررسی است. نخست از جهت ایرادات مقدماتی، سپس از لحاظ موضوعات ماهوی. از آنجا ‌که ایرادات مقدماتی نوعاً موضوعات و مباحث حقوقی را مطرح می‌کنند، احتمال تبعیت دیوان از یافته‌های قبلی خود در این موارد در مقایسه با موضوعات ماهوی بیشتر است.

چکیده English

This paper aims to explore the potential influence of the International Court of Justice's (ICJ/ the Court) judgment delivered on March 30, 2023, in the Certain Iranian Assets Case on the upcoming judgment in the case concerning Alleged Violations of the 1955 Treaty of Amity between Iran and the United States. Given the Court's consistent emphasis on maintaining fidelity to its precedent, particularly in cases dealing with violations of the Treaty of Amity, it becomes imperative to assess the potential impact of the Court's previous judgment on the pending case. This assessment encompasses both the Court's decision on preliminary issues and its final judgment on the merits. As the examination of preliminary issues primarily involves legal and juridical questions, the effect of the earlier judgment on the pending case is likely to be of greater significance.
